Defence counsel in Col Dr Kizza Besigye’s ongoing treason trial put Chief State Attorney Joseph Kyomuhendo under intense scrutiny during cross-examination at the High Court on May 6, 2026.

Lawyers, led by Erias Lukwago, demanded details on alleged electronic threats against witnesses, which the state claims justify concealing identities of six out of ten prosecution witnesses. Kyomuhendo admitted the threats came from a digital lab analysis but repeatedly declined to reveal sources, dates, or the forensic expert involved, saying it would compromise security.

Pressed on specifics like the form of evidence and storage, Kyomuhendo stuck to generalities, noting reports existed but were not in court. He confirmed threats targeted all six protected witnesses via Frank Kiherere, an alleged accomplice, but couldn’t recall timelines without his report.

Tensions peaked when Lukwago questioned if witnesses were in hiding, prompting Kyomuhendo’s retort: ‘Do you want to hunt them down?’ The judge recorded the refusal but permitted questioning. Defence highlighted inconsistencies, such as protecting only six witnesses and the late March 2026 application despite the case running for months.

Kyomuhendo outlined alternatives like audio-visual testimony or screened boxes but deemed them insufficient against intimidation and retaliation. He assured post-testimony safety measures, a point defence called contradictory.

The case accuses Besigye, Obeid Lutale, and UPDF officer Oola of plotting to overthrow the government from 2023 to November 2024, with meetings abroad.
