Besigye Sues Gen. Muhoozi Over Martha Karua's Deportation

Dr. Kizza Besigye, along with co-accused Hajji Obeid Lutale, has initiated legal action against Chief of Defence Forces General Muhoozi Kainerugaba. The lawsuit, filed in the High Court, centers on the alleged unlawful deportation of Kenyan lawyer Martha Karua, who was scheduled to represent them in a treason case.
According to court documents, Karua arrived at Entebbe International Airport on June 22, 2026, to represent Besigye and Lutale. However, she was reportedly prevented from entering Uganda, detained, had her phones confiscated, and was subsequently deported to Nairobi after being declared a prohibited immigrant.
Besigye and Lutale argue that Karua’s deportation is part of a deliberate effort to hinder their defence. They are seeking a court declaration affirming their right to choose their legal counsel, including Karua, whom they have instructed since November 2024.
The applicants contend that classifying Karua as a prohibited immigrant was unlawful, as “persona non grata” is not a valid ground under Ugandan immigration law. Furthermore, they assert that Karua was denied due process and a fair hearing, with the confiscation of her phones violating their right to confidential lawyer-client communication.
The lawsuit also brings attention to the alleged intimidation of their legal team, including the arrest and prosecution of lawyer Erias Lukwago. Besigye and Lutale claim Lukwago’s charges are politically motivated due to his representation of them.
Additionally, the applicants accuse Gen. Muhoozi of making public statements that prejudged Besigye’s guilt, threatened his life, and claimed responsibility for Karua’s deportation. These statements, they argue, violate Besigye’s constitutional rights to the presumption of innocence and life.
Besigye and Lutale are seeking the nullification of Karua’s prohibited immigrant status, an injunction to prevent future interference with her representation, and damages for the alleged violations of their constitutional rights. The High Court has yet to schedule a hearing for the case.
