In a significant 6-3 decision, the United States Supreme Court has halted former President Donald Trump’s executive order that aimed to limit birthright citizenship. The court’s ruling reaffirms the long-standing constitutional interpretation of the 14th Amendment, which grants citizenship to virtually all individuals born within the United States.
Trump’s executive order sought to deny automatic citizenship to children born in the U.S. to undocumented immigrants and those on temporary visas. The Supreme Court’s decision effectively nullifies this directive.
Writing for the majority, Chief Justice John Roberts stated that the constitutional text is unambiguous. He highlighted that the 14th Amendment, adopted after the Civil War, was intended to secure citizenship for formerly enslaved individuals born in the U.S.
Roberts emphasized the amendment’s clear language: “All persons born or naturalised in the United States and subject to the jurisdiction thereof, are citizens of the United States.” The court dismissed arguments from Trump’s legal team suggesting that undocumented migrants are not fully “subject” to U.S. jurisdiction, finding no constitutional basis for this interpretation.
This ruling represents a major setback for Trump, who had personally attended the oral arguments and publicly supported the executive order. Legal experts suggest that overturning this established precedent would require a constitutional amendment, a process that is both rare and exceedingly difficult in the U.S.
