The Magistrates Court in Luzira saw a tense afternoon session on Wednesday as the bail hearing for former Ethics and Integrity Minister Dr. Miria Matembe got underway following an earlier adjournment. Dr. Matembe, currently held at Luzira Prison, faces charges of promoting sectarianism, stemming from remarks she allegedly made during a television program concerning national resource allocation.
The defence team, spearheaded by lawyer Anthony Asiimwe, presented a comprehensive bail application highlighting Dr. Matembe’s considerable age of 73, her fragile health, distinguished public service record, and fundamental constitutional rights. Asiimwe stressed her status as a senior citizen and a pivotal figure in Uganda’s constitutional development, having served as a former minister and contributing to the 1995 Constitution.
A significant point of contention raised by the defence was the manner of Dr. Matembe’s apprehension. They alleged that her home was invaded on June 23, 2026, by armed individuals who scaled the perimeter wall. Subsequently, on June 28, she was reportedly blindfolded, apprehended, and transported in what was described as a “drone,” remaining incommunicado until her court appearance on June 30.
Lawyers further presented evidence of Dr. Matembe’s poor health, citing severe back pain and urging the court to consider her condition in its bail decision. “The accused is visibly frail and of advanced age,” Asiimwe stated, arguing that these factors, combined with her strong community ties and lack of any prior criminal record, indicate she is not a flight risk.
The defence also contended that the charges, rooted in political speech, should warrant a non-custodial release. They presented several prominent individuals, including MPs Lucy Akello and Naome Kabasharira, advocate Prima Kwagala, and law lecturer Godber Tumushabe, as sureties.
Supporters and activists gathered outside the court in solidarity, while security remained heightened around the premises as proceedings continued. The court is expected to deliver its ruling after reviewing all submissions from both the defence and the prosecution.
