A significant legal development has emerged in Uganda with Major General James Birungi, the former head of Defence Intelligence and Security (DIS), facing charges of fabricating intelligence before the General Court Martial. This situation is particularly notable as Birungi was a key figure in military intelligence when opposition leader Dr. Kizza Besigye was arrested in Nairobi and subsequently returned to Kampala to face treason charges.

Birungi, along with two other senior intelligence officers, was arrested in August 2025. The accusations include allegations of misconduct within the UPDF’s intelligence apparatus, stemming from a high-level inquiry. Human rights lawyer Eron Kiiza described the situation as unprecedented, noting that the very officers allegedly involved in fabricating intelligence and involved in Besigye’s arrest now face military justice.

The charges against Birungi and his co-accused, Lt Col Ephraim Byaruhanga and Col Peter Ahimbisibwe, reportedly include the manipulation or fabrication of intelligence reports, with a specific mention of a 2023 incident concerning claims about an ADF bomb-maker.

This development casts a shadow over the ongoing treason case against Dr. Besigye and Hajji Obeid Lutale. Besigye and Lutale have already filed a constitutional challenge, arguing their arrest in Nairobi constituted an unlawful abduction. The credibility of intelligence evidence, including that from officers now facing charges, is now under scrutiny.

The case creates an unusual intersection where the integrity of intelligence operations is being questioned internally, even as it forms a basis for high-profile prosecutions. The prosecution faces the challenge of addressing the broader implications of these allegations on the reliability of intelligence presented in court.
