In a significant legal development, the Malindi High Court in Kenya has ruled that the upcoming presidential election should be held next week, on August 11, 2026, not in 2027 as planned. Justice Mugure Thande delivered the ruling, stating that holding the election in August 2027 would contravene several articles of the Kenyan Constitution.

The court’s interpretation is based on the constitutional requirement for presidential elections to be held in the fifth year following the previous polls. Petitioners had argued that since the last presidential election was in August 2022, the next one should fall within the fifth year, specifically the second Tuesday of August 2026.

Justice Thande agreed with this interpretation, emphasizing that the Constitution fixes the election date within the fifth year and does not guarantee a President a full five-year term. The ruling declared that any date other than August 11, 2026, for the next presidential election would be null and void.

However, recognizing the potential for national instability, the court suspended the immediate effect of its declaration. This means the Independent Electoral and Boundaries Commission (IEBC) will proceed with the planned 2027 elections. Justice Thande explained that postponing or cancelling the 2027 election at this stage would likely lead to chaos, and the court needed to balance legal enforcement with judicial restraint.

The ruling is intended to clarify legal ambiguities regarding presidential election timelines and provide certainty for future electoral processes. Despite the ruling, the 2027 election will proceed as scheduled, with the court’s findings aimed at guiding future electoral calendar decisions.
