Former Butambala Member of Parliament Muhammad Muwanga Kivumbi will not be required to report to court monthly while he is incarcerated. The High Court’s Criminal Division, presided over by Justice Susan Okalanyi, granted this exemption, stating it is impractical to expect him to report while in prison.

This decision specifically addresses Kivumbi’s situation, acknowledging his current inability to comply with the bail condition due to his imprisonment. The court’s ruling clarifies that the monthly reporting requirement is suspended for him as long as he remains in the custody of prison authorities.

However, the judge upheld the monthly reporting condition for Kivumbi’s 22 co-accused. These individuals are currently out on bail and must continue to adhere to all the conditions set by the court, including regular appearances.

Kivumbi and his co-accused are facing terrorism-related charges. Bail was previously granted with several conditions, including monthly reporting, travel restrictions, and other measures to ensure their availability to the court. Kivumbi’s continued detention at Kitalya Prison has made compliance with these conditions impossible.

Kivumbi’s legal team remains confident in their defense, with lawyer Samuel Muyizzi asserting that the prosecution has failed to present sufficient evidence to support the charges. The defense is awaiting Kivumbi’s appearance at the Butambala Court tomorrow as they press forward with his bail application and challenge the evidence disclosure by the prosecution.

The case continues as the defense contests the allegations and seeks Kivumbi’s release, while his co-accused remain bound by their bail conditions.
