Court Warns of Mukulu's Release Over Witness Absence

The International Crimes Division of the High Court has issued a strong warning regarding the ongoing trial of former Allied Democratic Forces (ADF) commander Jamilu Mukulu and his co-accused. The court indicated it might be compelled to release the defendants on bail or force the prosecution to conclude its case if state witnesses continue to be absent.

This stern message was delivered after the prosecution, represented by Assistant Director of Public Prosecutions Thomas Jatiko, informed the presiding judges that six witnesses scheduled to testify this week were unavailable. The reason cited for their absence was that they had returned to their homes in the Busoga region to attend to their gardens following recent heavy rainfall.

The defense, led by lawyer Caleb Alaka, has previously raised concerns about Mukulu’s treatment in detention, including allegations of isolation and harsh prison conditions. Mukulu himself faces a raft of serious charges, including terrorism, murder, aggravated robbery, attempted murder, and belonging to a terrorist organization.

The repeated adjournments due to witness non-appearance are significantly delaying the trial, prompting the court’s ultimatum. The prosecution now faces pressure to ensure witness attendance or risk the case being dismissed, potentially allowing Mukulu and his co-accused to walk free.

This development highlights the challenges faced by the justice system in prosecuting complex terrorism cases, particularly when logistical and personal reasons prevent key witnesses from fulfilling their judicial obligations. The court’s patience appears to be wearing thin as it seeks to move the long-delayed trial forward.
