Justice Chibita: Sloppy Judgments Erode Public Trust in Judiciary

Judicial officers have been urged to prioritize clarity, timeliness, and logical reasoning in their judgments to uphold public confidence in the justice system. Poorly written or delayed decisions can significantly undermine trust, even if the trial itself was fair. Justice Mike Chibita, the head of the Judicial Training Institute Governing Council, has stressed the critical importance of well-crafted judgments in maintaining public faith in the courts. He stated that even a competently conducted trial can have its credibility undermined by a poorly written or unduly delayed ruling.

Speaking at a training session for over 200 magistrates from Western Uganda in Kampala, Justice Chibita emphasized that clear, reasoned, and timely judgments are fundamental to transparency, consistency, and accountability within the justice system. Such decisions not only inform the parties involved about the outcome and their responsibilities but also provide a solid foundation for any potential appeals.

Justice Chibita, who also serves as a Supreme Court judge, highlighted that the Judiciary has introduced digital tools to streamline the judgment-writing process. These include ULII for accessing legal precedents and a dedicated judgment-writing tool launched by the Chief Justice, designed to offer a structured approach and reduce the time spent on drafting.

During the training, magistrates voiced several challenges they face. These included difficulties in assessing witness credibility when testimonies conflict, the complexity of dealing with lengthy legal submissions from lawyers, and situations where lawyers fail to submit arguments, leaving judges to navigate complex disputes without clear legal guidance.

The training aims to enhance the capacity of judicial officers and improve the overall quality and efficiency of justice delivery in Uganda, reinforcing the Judiciary’s commitment to accessible and trustworthy legal outcomes.
