The High Court sitting in Luweero has officially upheld the election of National Unity Platform (NUP) candidate Brenda Nabukenya as the Luweero District Woman Member of Parliament. Justice Vincent Emmy Mugabo delivered the ruling, dismissing an election petition filed by her National Resistance Movement (NRM) rival, Agnes Kirabo Nantongo, which contested the outcome of the January 15, 2026 general elections.
During the polls, the Electoral Commission officially declared Nabukenya the winner after securing 67,399 votes, defeating Kirabo, who garnered 55,696 votes. This left Nabukenya with a decisive majority of 11,703 votes. However, Kirabo challenged the results in court, claiming that her independent computation of certified Declaration of Results forms showed she had actually won with 67,883 votes against Nabukenya’s 66,864.
After a thorough examination of competing declaration forms, tally sheets, and election records, Justice Mugabo ruled that Kirabo failed to prove her allegations. The court found that Nabukenya’s documents were far more reliable because their figures corresponded accurately with polling station tally sheets and official ballot accounts. In contrast, the judge noted that some declaration forms presented by Kirabo contained unresolved discrepancies.
While affirming Nabukenya’s victory, Justice Mugabo heavily criticized the Electoral Commission for issuing conflicting certified election records, warning that such discrepancies undermine public trust. The court also struck out affidavits sworn by five electoral officials after the Commission disowned them. Ultimately, the judge ruled that Kirabo failed to discharge her burden of proof under the Parliamentary Elections Act, dismissed the petition, and ordered her to pay the legal costs incurred by both Nabukenya and the Electoral Commission.
